- ▸ Mines and Minerals (Development and Regulation) Act 1957 — The parent statute governing the regulation of mines and the development of minerals in India. Section 4 requires that no person undertake any reconnaissance, prospecting or mining operation in any area except under a permit, licence or lease granted under the Act. Section 8A (introduced by the MMDR Amendment Act 2015) provides for the grant of mining leases by auction for all minerals other than coal, lignite and atomic minerals — the post-2015 regime under which any fresh iron ore mining lease is granted through a competitive auction where the successful bidder holds the lease for 50 years. Section 9 requires the holder of a mining lease to pay royalty at the rate specified in the Second Schedule for the mineral removed or consumed. The Second Schedule for iron ore prescribes an ad valorem royalty at 15 percent of the sale price on the basis of the Indian Bureau of Mines Index (IBMI) benchmark price for lump ore (all grades) and 10 percent of the IBMI benchmark price for fines (all grades) — with separate IBMI notifications for lump, fines, blue dust and concentrate published monthly by the Indian Bureau of Mines. Section 9B (introduced by the MMDR Amendment Act 2015) requires the holder of a mining lease to pay to the District Mineral Foundation (DMF) 30 percent of the royalty for post-2015 leases and 10 percent for pre-2015 leases. Section 9C (introduced by the MMDR Amendment Act 2015) requires the holder of a mining lease to pay to the National Mineral Exploration Trust (NMET) a sum equivalent to 2 percent of the royalty.
- ▸ Metalliferous Mines Regulations 1961 and Mineral Conservation and Development Rules 2017 — The Metalliferous Mines Regulations 1961 (MMR 1961) framed by the Directorate General of Mines Safety (DGMS) under the Mines Act 1952 prescribe safety, health and welfare standards for metalliferous mines including iron ore, manganese, bauxite and other metallic minerals — mandatory ventilation, illumination, dust suppression, hoisting and haulage engineering, blast design and blast hole spacing, bench height and slope stability, and mine surveyor certification for the monthly extraction certificate that anchors the royalty computation. The Mineral Conservation and Development Rules 2017 (MCDR 2017) framed by the Indian Bureau of Mines (IBM) under the MMDR Act 1957 prescribe the mine plan approval framework — an approved mine plan is a pre-condition to the grant and operation of any mining lease; the mine plan documents the geological setting, reserves and resources classification under the United Nations Framework Classification (UNFC), the mining method, the annual production plan, the mineral conservation plan and the progressive mine closure plan. The MCDR 2017 also prescribes the annual return filing (MCDR Form F1 or F2 for major mineral leases) and the F&F (Financial and Fuel) Report annual filing to IBM documenting mineral production, sale price, royalty payment, DMF and NMET contribution and the year-on-year reserves reassessment position.
- ▸ MMDR Amendment Act 2015 — Section 9B (District Mineral Foundation) and PMKKKY framework — Section 9B introduced by the MMDR Amendment Act 2015 requires the establishment of a District Mineral Foundation (DMF) in every district affected by mining operations as a non-profit trust. The holder of an iron ore mining lease grants (a) for mining leases granted before 12 January 2015, an amount notified at 10 percent of royalty by the Central Government; (b) for mining leases granted on or after 12 January 2015, an amount notified at 30 percent of royalty. The DMF fund is administered by a district-level governing council chaired by the District Collector under the Pradhan Mantri Khanij Kshetra Kalyan Yojana (PMKKKY) implementation framework issued by the Ministry of Mines. PMKKKY prescribes that at least 60 percent of the DMF fund is utilised for high-priority areas (drinking water supply, health-care, sanitation, education, welfare of women and children, welfare of aged and disabled, skill development, environment preservation and pollution control) and up to 40 percent for other priority areas (physical infrastructure, irrigation, energy and watershed development). The DMF fund is deposited directly by the mining lease holder into the DMF bank account and does not pass through the State treasury. Iron ore mining districts including West Singhbhum (Jharkhand), Keonjhar and Sundargarh (Odisha), Ballari and Chitradurga (Karnataka), Bastar (Chhattisgarh) and Anantapur (Andhra Pradesh) run some of the largest DMF corpuses in the country.
- ▸ MMDR Amendment Act 2015 — Section 9C (National Mineral Exploration Trust) — Section 9C introduced by the MMDR Amendment Act 2015 requires the establishment of the National Mineral Exploration Trust (NMET) as a Trust to be administered by a governing body constituted by the Central Government. The holder of a mining lease shall, in addition to the royalty and the amount paid to the DMF, pay to the NMET a sum equivalent to 2 percent of the royalty. The NMET fund is utilised for regional and detailed mineral exploration in the country. The 2 percent NMET contribution is deposited directly by the mining lease holder into the NMET bank account maintained with the designated Central Government agency (currently the Ministry of Mines through the Geological Survey of India nodal account). NMET returns are filed quarterly on or before the 15th of the month following the quarter.
- ▸ Indian Bureau of Mines Index (IBMI) benchmark price notification — The Indian Bureau of Mines (IBM) publishes a monthly Indian Bureau of Mines Index (IBMI) benchmark price for iron ore lump, fines, blue dust and concentrate — the reference price that drives the ad valorem royalty computation under the Second Schedule of the MMDR Act 1957 for iron ore. The IBMI benchmark price is derived from actual sale price data collected across mining lease holders, state-specific price adjustments and grade-wise (Fe content grades — 65 percent and above, 62-65 percent, 60-62 percent, 58-60 percent, 55-58 percent, below 55 percent) differentiation. For a lump-and-fines mining lease, the monthly royalty computation applies the IBMI-lump benchmark to the lump extraction volume at 15 percent ad valorem and the IBMI-fines benchmark to the fines extraction volume at 10 percent ad valorem. Any deviation between the actual sale price realised by the mining lease holder (for lease holders that sell iron ore to third parties in the merchant-mining model) and the IBMI benchmark price is a computation-level dispute typically resolved through the state-mines-department appellate mechanism under Rule 27 of the Mineral Concession Rules 1960.
- ▸ Ind AS 16 Property, Plant and Equipment (Companies (Indian Accounting Standards) Rules 2015) — Ind AS 16 governs the accounting for property, plant and equipment. Paragraph 16 provides that the cost of an item of property, plant and equipment comprises its purchase price, any costs directly attributable to bringing the asset to the location and condition necessary for it to be capable of operating in the manner intended by management, and the initial estimate of the costs of dismantling and removing the item and restoring the site on which it is located. For a captive iron ore mining lease, the upfront lease premium payable at grant (auction premium under Section 8A of the MMDR Act 1957 quoted as a percentage of the sale value of the mineral for post-2015 leases, or negotiated premium under the pre-2015 regime), the mining rights acquisition costs, the mine development costs (overburden removal, haul road construction, initial pit development, benching and dewatering infrastructure, mineral processing plant capex including crushing and screening plant) and the mine restoration provisioning under Ind AS 37 are capitalised to a mining-rights-and-mine-development block within property, plant and equipment. The block is depreciated over the useful life of the mining lease (30 years for pre-2015 leases, 50 years for auction-based post-2015 leases) or the estimated economically-recoverable-reserves life, whichever is shorter, on either the units-of-production method or the straight-line method as the entity accounting policy provides.
- ▸ Ind AS 2 Inventories (Companies (Indian Accounting Standards) Rules 2015) — Ind AS 2 governs the accounting for inventories. Paragraph 10 provides that the cost of inventories comprises all costs of purchase, costs of conversion and other costs incurred in bringing the inventories to their present location and condition. For an integrated steel plant captive iron ore franchise, the per-tonne royalty payable under Section 9 of the MMDR Act 1957 (ad valorem 15 percent for lump, 10 percent for fines on the IBMI benchmark price), the per-tonne DMF contribution under Section 9B, the per-tonne NMET contribution under Section 9C, the mining operations cost (drilling, blasting, loading, haulage from mine to processing plant), the crushing and screening cost at the mineral processing plant, the sinter plant conversion cost for fines and the transport cost from mine to blast furnace or sinter feed yard at the integrated steel plant together form the cost of the iron ore raw material input to the blast furnace or the DRI (Direct Reduced Iron) unit. These variable operating costs are expensed under Ind AS 2 as part of the cost of the hot metal or DRI inventory under the weighted-average cost formula per paragraph 25.
- ▸ Income-tax Act 1961, Section 194Q and Section 194Q(3) Government payee exemption — Section 194Q of the Income-tax Act 1961 (introduced by Finance Act 2021, effective 1 July 2021) requires any person, being a buyer, who is responsible for paying any sum to any resident seller for purchase of any goods of the value or aggregate of such value exceeding fifty lakh rupees in any previous year, to deduct tax at source at the rate of 0.1 percent of the sum exceeding fifty lakh rupees at the time of credit or payment whichever is earlier. Section 194Q(3) provides that the provisions of Section 194Q shall not apply to purchase of goods from any person, being (a) a Government or an authority established by or under any Central Act or Provincial Act, whose income is exempt from income-tax; or (b) such other person as the Central Government may notify. Royalty, DMF and NMET payments made by a mining lease holder to the State Government, the district DMF authority and the Central Government NMET agency respectively are payments to Government payees and are outside the scope of Section 194Q. Third-party iron ore purchase from NMDC (a Central Government PSU whose applicability is governed by the specific CBDT circular position on Government-owned enterprises) or from an independent private-sector mining lease holder (Sesa Goa, OMDC, private-lease iron ore merchant) above the fifty lakh rupees aggregate threshold per previous year attracts Section 194Q 0.1 percent buyer-side TDS at the point of payment or credit.
